1. Acceptance of Terms

By downloading, accessing, or using the SpinDate mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. SpinDate reserves the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting.

2. Description of Service

SpinDate is a dating and social discovery application that enables users to meet and connect with other people through a unique spinning mechanism. The App provides:

  • A dynamic spinning wheel interface for discovering profiles based on selected categories
  • Real-time messaging capabilities between matched users
  • A visual storytelling feed for sharing authentic moments
  • Category-based profile matching and discovery
  • Premium subscription features and in-app purchases

3. Age Requirement and Eligibility

You must be at least 18 years old to use SpinDate. By creating an account, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into this agreement
  • You are not prohibited from using the App under applicable laws
  • You have not been previously banned from using SpinDate

We reserve the right to verify your age and may request identification documents. Accounts found to be created by users under 18 will be immediately terminated.

4. Account Registration and Security

4.1 Account Creation

To use SpinDate, you must create an account by providing accurate, current, and complete information. You agree to:

  • Provide truthful information about yourself, including accurate photos
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4.2 Profile Content

Your profile must accurately represent you. Prohibited profile content includes:

  • Photos of other people, celebrities, or stock images
  • False or misleading information about your age, appearance, or identity
  • Contact information (phone numbers, email addresses, social media handles)
  • Promotional or commercial content
  • Nudity, sexually explicit content, or inappropriate imagery

5. Subscriptions and Premium Features

5.1 Subscription Plans

SpinDate offers premium subscription plans that provide access to enhanced features. Subscription plans may include:

  • Unlimited spins and profile discoveries
  • Advanced filtering and search options
  • Priority visibility in discovery feeds
  • Read receipts and message status indicators
  • Ad-free experience
  • Additional premium features as described in the App

5.2 Subscription Terms

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. By purchasing a subscription, you authorize SpinDate to charge your payment method for the renewal period.

Billing: Subscription fees are charged to your Apple App Store or Google Play Store account. Prices may vary by location and are subject to change with 30 days' notice.

Cancellation: You may cancel your subscription at any time through your device's App Store settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to premium features until the end of the paid period.

Refunds: Refunds are subject to the policies of Apple App Store and Google Play Store. SpinDate does not provide direct refunds. If you believe you are entitled to a refund, contact Apple or Google support directly.

5.3 In-App Purchases (Coins/Credits)

SpinDate may offer virtual currency ("Coins" or "Credits") for purchase. Coins are non-refundable and have no cash value. Coins may be used for:

  • Additional spins beyond your subscription limit
  • Premium features and boosts
  • Special profile enhancements
  • Other in-app features as described in the App

Coins do not expire but are non-transferable and cannot be exchanged for cash or other goods.

6. User Conduct and Prohibited Behavior

You agree to use SpinDate in a respectful and lawful manner. Prohibited conduct includes:

  • Harassment: Bullying, stalking, threats, or any form of harassment towards other users
  • Fraud: Scamming, catfishing, or misrepresenting your identity
  • Illegal Activities: Soliciting illegal services, drug dealing, or any criminal activity
  • Commercial Use: Using the App for business, advertising, or commercial purposes
  • Spam: Sending unsolicited messages, promotional content, or repetitive communications
  • Inappropriate Content: Sharing explicit sexual content, violence, hate speech, or offensive material
  • Account Sharing: Sharing your account with others or creating multiple accounts
  • Circumvention: Attempting to bypass App features, restrictions, or security measures

7. Messaging and Communication

SpinDate enables direct messaging between users once a profile is revealed through the spinning mechanism. You agree that:

  • All messages are subject to our moderation and safety policies
  • You will not send spam, unsolicited commercial messages, or harmful content
  • You will respect other users' boundaries and consent
  • SpinDate may monitor messages for safety, compliance, and quality assurance
  • You are solely responsible for the content of your messages
  • We reserve the right to restrict or disable messaging features for accounts that violate these Terms

8. Content Ownership and License

8.1 Your Content

You retain ownership of all content you post on SpinDate, including photos, text, and other materials. By posting content, you grant SpinDate a worldwide, non-exclusive, royalty-free, perpetual license to:

  • Use, reproduce, modify, and distribute your content within the App
  • Display your content to other users as part of the App's functionality
  • Use your content for App promotion and marketing (with your consent for marketing use)

8.2 Content Removal

You may delete your content at any time. However, content that has been shared with other users may remain visible until they refresh their view. We reserve the right to remove any content that violates these Terms.

9. Safety and Moderation

SpinDate employs a dedicated moderation team to ensure user safety. We reserve the right to:

  • Review, monitor, and remove any content or profiles that violate these Terms
  • Suspend or permanently ban accounts that engage in prohibited behavior
  • Report illegal activities to law enforcement authorities
  • Block users from contacting you if you report them
  • Take any action necessary to protect the safety and integrity of our community

User Safety: While we strive to create a safe environment, you are responsible for your own safety when meeting people in person. Always meet in public places, inform friends of your plans, and trust your instincts.

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

11. Termination

11.1 Termination by You

You may delete your account at any time through the App settings. Upon account deletion:

  • Your profile and content will be removed from the App
  • Your active subscription will be cancelled (no refund for unused time)
  • Any unused Coins will be forfeited
  • Some information may be retained as required by law or for safety purposes

11.2 Termination by SpinDate

We may suspend or terminate your account immediately, without notice, if you:

  • Violate these Terms or our Community Guidelines
  • Engage in illegal, harmful, or fraudulent activity
  • Create multiple accounts or share your account
  • Fail to pay subscription fees
  • Otherwise misuse the App

Upon termination, your right to use the App immediately ceases, and we may delete your account and content.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SPINDATE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the App will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or quality of user profiles or content
  • Warranties that you will find matches or have successful interactions

SPINDATE DOES NOT VERIFY THE ACCURACY OF USER-PROVIDED INFORMATION AND IS NOT RESPONSIBLE FOR USER CONDUCT OR INTERACTIONS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPINDATE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the App
  • Damages resulting from interactions with other users, including in-person meetings
  • Damages resulting from unauthorized access to or alteration of your data

IN NO EVENT SHALL SPINDATE'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO SPINDATE IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless SpinDate, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another user or third party
  • Your content or conduct on the App

15. Dispute Resolution

If you have a dispute with SpinDate, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree to resolve disputes through binding arbitration, except for claims that may be brought in small claims court.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

  • In-app notifications
  • Email to your registered address
  • Updates to the "Last Updated" date

Your continued use of the App after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and delete your account.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SpinDate operates, without regard to conflict of law principles.
